These Terms of Service ("Terms") govern access to and use of eventsub, a live captioning and translation service for in-person events, operated by Goh Zi Wei (sole proprietor, Malaysia; SSM registration no. not yet registered with SSM; registration is in progress) ("eventsub", "we", "us"). By accessing or using eventsub, you ("Customer", "you") agree to be bound by these Terms. If you do not agree, do not use the service.

1. Service Description

  1. eventsub is a web-based service that captures audio from a microphone at a live event through a browser, generates real-time captions of the spoken audio, and, where enabled, translates those captions into up to three (3) target languages. Attendees view captions on their own devices by scanning a QR code or opening a provided link.
  2. The service is offered in two tiers: (a) Free — original-language captions only; and (b) Pro — includes translation, unlocked via a partner-issued access password. A free trial of up to five (5) minutes is available to evaluate the service before purchase or password activation.
  3. eventsub requires an active internet connection, a functioning microphone input, and a modern web browser. We do not provide event audio-visual equipment, microphones, staging, or on-site technical personnel unless separately agreed in writing.

2. Accuracy Disclaimer

Speech recognition and machine translation are inherently imperfect. eventsub does not guarantee 100% accuracy of captions or translations.
  1. Caption and translation output may contain errors, omissions, mistranslations, or delays, particularly with accents, background noise, overlapping speech, technical terminology, code-switching, or poor audio quality.
  2. eventsub is provided as a live-communication aid and must not be relied upon as an official transcript, a certified translation, a legal record, or a substitute for professional interpretation in contexts where accuracy is safety-critical, legally binding, or medically significant (e.g. courtrooms, medical consultations, regulatory hearings).
  3. Customer is responsible for informing event organisers, speakers, and attendees that captions are machine-generated and may be imperfect.

4. Accounts and Password Responsibility

  1. Pro access is granted via a password issued to Customer or Customer's organising partner. Customer is responsible for keeping this password confidential and for all activity conducted using it.
  2. A Pro access password is issued for a specific event and/or organisation and is not transferable to a different organisation, event, or unrelated third party without our prior written consent. Attempting to transfer, resell, or sublicense access outside its issued scope is a breach of Section 3 (Acceptable Use).
  3. eventsub is not liable for unauthorised use of an access password that results from Customer's failure to safeguard it. Customer must notify us promptly at the contact below if a password is lost, stolen, or suspected compromised.
  4. We may deactivate or rotate a password at any time to protect the integrity of the service, with notice to Customer where reasonably practicable.

5. Third-Party Services

eventsub's speech recognition is powered by a third-party provider, our speech-recognition provider. Audio captured during a session is streamed to our speech-recognition provider in real time solely to generate captions and is not recorded or stored by eventsub; caption and translation text is likewise not retained after the session ends. Use of the service is also subject to the availability and performance of our speech-recognition provider's infrastructure, which is outside our control. We are not responsible for outages, errors, or changes in our speech-recognition provider's service that affect eventsub's performance.

6. Intellectual Property

  1. eventsub retains all rights, title, and interest in the eventsub software, website, branding, and underlying technology. Nothing in these Terms transfers any such rights to Customer.
  2. Customer retains all rights to the audio content and source material presented at their event. Customer grants eventsub a limited right to process that audio in real time solely to provide the captioning and translation service, with no retention beyond the live session as described in Section 5.

7. Fees and Refunds

Fees for Pro access are as quoted or invoiced to Customer at time of purchase; see our Pricing page for current rates. Refund requests are handled under our separate Refund Policy, which forms part of these Terms by reference.

8. Disclaimer of Warranties

eventsub is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that captioning or translation will be accurate, complete, or available without interruption.

9. Service Availability; No SLA

  1. eventsub depends on internet connectivity, browser support, and third-party infrastructure (including our speech-recognition provider and our hosting provider) that we do not control. We do not guarantee uninterrupted, timely, secure, or error-free operation of the service, and we do not offer a service-level agreement (SLA) with guaranteed uptime percentages or service credits, for either the Free or Pro tier, unless separately agreed in writing for a specific engagement.
  2. We recommend testing your setup (microphone, network, browser) before a live event, and treating eventsub as one part of your event's communication plan rather than its sole channel.
  3. Scheduled maintenance or third-party outages may interrupt the service. We will make reasonable efforts to notify Customer of known planned maintenance affecting a confirmed booking.

10. Force Majeure

  1. Neither party is liable for any failure or delay in performance under these Terms resulting from causes beyond that party's reasonable control, including but not limited to: acts of God, natural disasters, fire, flood, war, civil unrest, terrorism, epidemic or pandemic, governmental action or restriction, internet or telecommunications infrastructure failure, power outage, or failure or unavailability of a third-party provider (including our speech-recognition provider, Stripe, or our hosting provider) ("Force Majeure Event").
  2. If a Force Majeure Event prevents performance for a scheduled engagement, we will notify Customer as soon as reasonably practicable and work in good faith to reschedule or, where rescheduling is not possible, apply the treatment described in Section 6 (Service-Side Issues) of the Refund & Cancellation Policy.

11. Limitation of Liability

  1. To the maximum extent permitted by Malaysian law, eventsub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, goodwill, or business opportunity, arising from or related to use of the service.
  2. eventsub's total aggregate liability arising out of or relating to these Terms or the service shall not exceed the total amount actually paid by Customer to eventsub for the specific event or service giving rise to the claim.
  3. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Malaysian law.

12. Service Changes and Termination

  1. We may modify, suspend, or discontinue any part of the service at any time, including features, language support, or pricing, with reasonable notice where the change materially affects an active engagement.
  2. We may suspend or terminate Customer's access immediately for breach of these Terms, including violations of Section 3 (Acceptable Use).
  3. Customer may stop using the service at any time. Termination does not entitle Customer to a refund except as provided under the Refund Policy referenced in Section 7.

13. Governing Law and Dispute Resolution

  1. These Terms are governed by the laws of Malaysia.
  2. Any dispute arising out of or in connection with these Terms shall first be addressed through good-faith negotiation between the parties. If unresolved within thirty (30) days, the dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date below. For a change that materially affects an active or upcoming confirmed booking, we will additionally notify Customer directly via the WhatsApp number or email address used at booking, where available, before the change takes effect for that booking. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
